The 4th Session of the UNIDROIT-ICC Working Group on International Investment Contracts took place in October in Rome. As reported earlier, among the most consequential topics under discussion are stabilisation/renegotiation/adaptation clauses, hardship and force majeure, as well as dispute settlement and applicable law clauses. The Working Group’s efforts regarding stabilization clauses, in particular, are to be watched, given the recognized negative effect of such clauses on policy reforms. The crucial outcome of the session was the presentation of the workplan for the next year, during which the draft instrument should be prepared.
