Swiss Federal Tribunal upholds intra-EU ECT award

As opposed to the approaches taken by various EU member states’ courts (see, e.g., here), the Swiss Federal Tribunal upheld an intra-EU investment award based on the ECT. The highest Swiss court did not consider that EU law arguments necessarily trump arguments based on other treaties, and in the case at hand found that the arbitration agreement based on the ECT prevails over the arguments based on EU law. The court therefore upheld the award.
