The German Constitutional Court rejected Achmea-related complaints

In September 2024, the German Constitutional Court has published two orders dated from July 2024 (here and here; both in German) together with a public statement rejecting the Dutch insurer’s challenge to the decision annulling the award in its favour. The Court considered the challenges inadmissible. The insurer also unsuccessfully challenged Germany’s decision to ratify the EU agreement to terminate  This decision is last in the series of German court decisions ruling against Achmea on the basis of the award annulled due to the decision of the Court of Justice of European Union.
