Grievance Mechanism – Johannesburg

To submit a grievance related to the SUNCASA project in Johannesburg, South Africa, please follow the instructions outlined below.

  • Commission for Conciliation, Mediation and Arbitration (CCMA): https://www.ccma.org.za/

    • CCMA is a national public entity to which employers and employees (public and private) are entitled to access support for employment disputes or unfair treatment/ dismissal.  

    • The cases that CCMA manages include unfair dismissal, discrimination, harassment, disciplinary procedures, unfair labour practices according to the South African Labour Act, and related regulations. They also offer other services such as capacity building for labour law.  

    • The services are the most accessible to South African citizens, particularly low-income earners with limited resources for legal fees. CCMA is available to resolve any labour dispute that is happening or has happened within the borders of South Africa at no cost. 

  • The SUNCASA workforce will be employed by the Johannesburg Inner City Partnership (JICP). JICP is familiar with CCMA and has worked with them in the past to resolve labour issues raised by workers. They will continue to do so for SUNCASA and other projects they are involved in.   

  • Only direct SUNCASA project participants can submit grievances related to SUNCASA. CCMA processes are for employed individuals, not complainants from outside. 

  • There are various ways of submitting grievances: 

    • Call, email, or visit the CCMA offices in person. The most popular means are submissions in physical offices that are spread out in the country.  

  • All cases are handled by the CCMA. The CCMA allocates an official from the Department of Labour or arbitrator for every case.  

  • JICP will be notified when a grievance is submitted and resolved and will keep track of these cases for monitoring purposes. 

  • The CCMA mechanism will be communicated to the workers on a daily basis as part of the toolbox talk (before work commences about what to expect and possible tasks ahead of the start of the day).
